1. Acceptance of Terms

By downloading, installing, or using the Culturista mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Culturista is a fitness tracking application that allows users to log workouts, follow training programs, track exercise progress, and manage their fitness routines. The App is provided for informational and tracking purposes only.

3. Health and Fitness Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The workout programs, exercise suggestions, and fitness tracking features provided by the App are for general informational purposes only.

• Not Medical Advice: Nothing in the App constitutes medical advice, diagnosis, or treatment. Always consult your physician or qualified healthcare provider before starting any new exercise program, particularly if you have any pre-existing health conditions, injuries, or concerns.
• Exercise at Your Own Risk: You acknowledge that physical exercise involves inherent risks, including but not limited to physical injury, disability, and death. You voluntarily assume all risks associated with any exercise or physical activity you perform while using the App.
• No Liability for Injuries: To the fullest extent permitted by applicable law, the developer, its affiliates, officers, employees, and agents shall not be liable for any injuries, damages, or losses of any kind arising from or related to your use of the App, including but not limited to injuries sustained during exercise, improper form, equipment malfunction, or any other cause related to physical activity.
• Individual Responsibility: You are solely responsible for determining whether any exercise, workout program, or weight suggestion provided by the App is appropriate for your fitness level and physical condition.
• Smart Set Calculations: The App's smart warm-up and drop-set weight calculations are algorithmic suggestions only. You must verify that any suggested weight is safe and appropriate for you before lifting.

4. Subscription Terms

4.1 Free Trial

Culturista may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

4.2 Billing

Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

4.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next billing period following notice of the change.

5. User Content and Data

All workout data, exercise logs, and personal records you create within the App are stored locally on your device. You are responsible for backing up your data.

6. Intellectual Property

The App, including its design, features, content, and branding, is the property of the developer and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the App.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall the developer's total liability exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

9. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Privacy Policy

1. Information We Collect

1.1 Data Stored Locally

Culturista stores all your workout data, exercise logs, personal records, and preferences locally on your device using Apple's SwiftData framework. This data never leaves your device unless you explicitly export it.

1.2 Data We Do Not Collect

• We do not collect personal identification information (name, email, address)
• We do not collect location data
• We do not collect health data from HealthKit
• We do not use analytics or tracking SDKs
• We do not share any data with third parties

2. Subscription Data

Subscription purchases are processed entirely through Apple's App Store. We do not have access to your payment information. Apple may collect data as described in their privacy policy.

3. Data Security

Your data is stored locally on your device and protected by your device's built-in security features (passcode, Face ID, Touch ID). We do not transmit your data to any external servers.

4. Data Deletion

You can delete all your data at any time by uninstalling the App from your device. Individual workout logs and exercises can be deleted within the App.

5. Children's Privacy

The App is not intended for use by children under the age of 13. We do not knowingly collect information from children under 13.

6. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy within the App.
